Custody Evaluations
Court-ordered custody evaluations in Hawaiʻi
Hawaii child custody evaluations are court-ordered investigations conducted by licensed mental health professionals to determine the parenting plan that best serves the children’s interests. Evaluators assess home environments, interview parents and children, contact collaterals, and review medical and school records.

Observing the child and parent in their living environment — especially critical for younger children.

Who conducts an evaluation
Hawaii State law mandates that child custody evaluators be highly qualified mental health professionals — board-certified psychiatrists, psychologists, licensed clinical social workers, and licensed child and family therapists. The court generally appoints an evaluator from the state registry, though parties can sometimes mutually hire an agreed-upon private evaluator pending the judge’s approval. A licensed mental health professional who provides a comprehensive psychological assessment of the parents and a formal custody evaluation, taking into account all the facts of the case.
Best Interest Fact Finder
May be a legal or unlicensed mental health professional. Cannot perform clinical psychological testing and reports only on the facts of the case, without making a recommendation.
Guardian Ad Litem
An attorney appointed directly by the court to represent the best interests of the child.
